    • Two Plans to Improve Leniency Program

         Leniency program which is used by Korea Fair Trade Committee is criticized because exemption amount is too much. In this paper, I suggest two ways to improve the current program. First and simple way is to reduce exemption rate. More specifically, the rate which is applied to the firm which reports first is reduced from current 100% to the rate which makes the amount a firm which is the first and only reporter pays not greater than the amount when no firm reports. The rate applied to the second reporter is reduced to 0 from current 50%. The second plan uses exemption rate not based on the order of reporting but the number of reporters as well as the penalty to a firm which does not report while the other firm(s) reports. The penalty rate depends on the total exemption amount of the firm which report. The exemption rate when all report is 0. The penalty rate applies only when the other firms report and the rate can be very small.
    •    공정거래위원회에서 시행 중인 자진신고 감면제도는 감면액이 너무 많다는 문제점이 지적되고 있다. 이 논문에서는 이 문제를 해결하기 위한 두 가지 개선방안을 제시한다. 첫 번째 방안은 현행 제도에서 감면비율을 조정하는 것이다. 가장 먼저 신고하는 기업의 경우의 감면비율은 현재의 100%에서 모두 신고하지 않았을 때 해당 기업에게 징수할 수 있는 과징금보다 많지 않는 수준까지 낮춘다. 두 번째 신고한 기업의 경우는 현행 50%에서 감면해 주지 않는다. 두 번째 방안은 신고순서와 상관없이 신고 기업의 수에따라 차등을 두면서, 신고한 기업과 신고하지 않은 기업이 있는 경우, 신고 하지 않은 기업으로 하여금 신고한 기업이 감면 받은 과징금의 일정 금액을 추가 부담하도록 하는 방안이다. 이 방법의 경우, 모두 신고한 경우에는 감면해 주지 않는다. 또한 신고하지 않은 기업에 대한 추가 부담은 다른 기업이 모두 신고한 경우에만 적용하지만 그 비율은 아주 적어도 된다.

    • The Effects of Pirate Movie Distribution on the Number of Audience

         This study analyzes the effects of pirate movie distribution on the number of audience by using unique piracy detection data provided by Korea Copyright Commission. We used Sharp Kink RD(Regression Discontinuity) Model by Calonico, Cattaneo, and Titiunik(2014). We found that the distribution of pirate movie decreases the number of audience by 9% overall but it is not statistically significant. However, some movies got huge impacts: 59.7% decrease for General rating(for all ages) and 30.5% decrease for PG-12(Some material may be inappropriate for children under 12) rating. Also, piracy decreased the number of audience for animation about 53.8%. This result implies that the distribution of pirate movies has quite big impacts in some ratings and genres.
    •    본 연구는 한국저작권단체연합회의 영화 해적판 유통 적발자료를 이용하여, 해적판 유통이 극장관객수에 미치는 효과를 분석한다. 분석방법은 Calonico, Cattaneo, and Titiunik(2014)의 Sharp Kink 회귀불연속(Regression-discontinuity, RD) 모형을 이용하여 추정한다. 분석결과, 영화 전체에 있어서는 해적판 유통이 극장관객수를 9%를 감소시키지만 통계적으로 유의한 결과는 아니다. 하지만, 전체관람가 영화와 12세 이상 관람가 영화에 있어서는 해적판 유통이 극장관객수 감소에 각각 59.7%, 30.5%나 영향을 미치는 것을 발견하였다. 또한, 애니메이션 장르 영화의 해적판 유통은 극장관객수를 약 53.8% 감소시키고 있음을 확인하였다. 이러한 결과들은 일부 등급과 장르에 있어서 영화 해적판 유통이 극장관객수와 대체적 관계가 있으며, 불법적인 영화 해적판 유통이 일부 영화시장 매출액 감소로 이어져 영화시장을 위축시킬 가능성을 시사한다.
